  • The arbitrator(s) shall afford each of the Parties an opportunity to be heard and, except as otherwise provided herein, shall generally conduct the arbitration in accordance with the then-current arbitration rules of the CPR Institute for Dispute Resolution (formerly known as the Center for Public Resources), unless otherwise mutually agreed by the Parties.

  • Any dispute, controversy, or claim arising out of or relating to this Agreement shall be finally settled by arbitration in accordance with the CPR Institute for Dispute Resolution Rules for Non-Administered Arbitration then in effect (the “Rules”) by a sole arbitrator appointed in accordance with the Rules.

  • If a Dispute is not resolved by negotiation as provided in Section 1.2 within forty-five (45) days from the delivery of the Initial Notice, then either party may submit the Dispute for resolution by mediation pursuant to the CPR Institute for Dispute Resolution (the “CPR”) Model Mediation Procedure as then in effect.

  • All claims, disputes and controversies shall be submitted to the CPR Institute for Dispute Resolution (“CPR”) in accordance with the CPR’s rules then in effect; provided, however, that the evidentiary standards set forth in this Agreement shall apply.

  • If the Executives are unable to resolve the Dispute within thirty (30) Days following the commencement of their attempt to resolve the Dispute, the Dispute shall be finally resolved by arbitration by a panel of three arbitrators and pursuant to the CPR Institute for Dispute Resolution Rules for Administered Arbitration then in-effect, including any appellate provisions in those rules.

  • The CPR Institute for Dispute Resolution shall appoint a neutral advisor from its National CPR Panel.
