Court Pay. (1) When an off-duty member is subpoenaed to court and so reports, the member shall be paid or credited a minimum of four (4) hours at the member's appropriate rate of pay, unless the court clock-out time is within one-half (½) hour of the beginning of the member’s tour of duty or later. In the latter case, the member shall be paid at a rate of time and one-half (1½) for all hours worked up to the starting time for that tour of duty.

Court Pay. On-Duty - Eligible members subpoenaed to appear on-duty as a witness to any court proceeding connected with official duties shall receive their regular pay providing that all witness fees or pay are returned to the Department. Employees shall report to work when excused if their shift has not ended. Off-Duty - Eligible members required to appear off-duty in any court as a witness for job-related reasons shall be paid for all hours while off-duty and no additional compensation once the employee begins his/her regular duty schedule. If the eligible member’s entire appearance is made while off duty, he/she shall be paid with a minimum of two (2) hours overtime. If the eligible member’s appearance commences while off-duty, but continues into his/her regular duty hours, he/she shall be paid either the actual overtime worked or the $25 witness fee, whichever is greater. In either event, the eligible member shall also receive an hour at the premium rate for duces tecum subpoenas. All witness fees shall be returned to the Department.

Court Pay. Whenever an employee is required to appear during his regular off-duty time before any official court or before a prosecutor on matters pertaining to or arising from the employee’s official duties, the employee shall be compensated for a minimum of two (2) hours at the appropriate hourly rate of pay. If an employee appears before a court or at a pretrial conference for more than two (2) hours, such excess time shall also be compensated at the applicable rate.
Court Pay. ‌ Any represented employee who is required to be in court on off-duty time as part of his/her job duties shall be entitled to pay at the rate of time and one-half (1½) for all court time with a minimum entitlement of three (3.0) hours at time and one-half (1½). In addition, such employee shall be entitled to a maximum of one (1) hour of total travel time at time and one-half (1½) for such court appearance, unless the employee utilizes a City vehicle to travel to court. It is understood that a represented employee who is required to appear in court during his/her shift and who is required to stay beyond the end of his/her shift, shall be entitled to pay at the rate of time and one- half (1½), but shall not be entitled to any minimum number of hours or to any travel time.
Court Pay. Employees required to appear in court during non-duty hours as a result of their employment as a City Police Officer, shall receive overtime for two (2) hours, or overtime for the actual time spent on the court appearance, whichever is greater. If the employee is required to testify, an additional one (1) hour pay at the overtime rate shall be received. The above applies for each scheduled court case.

Court Pay. Employees required to appear in any judicial or administrative proceeding on official business on their off‐duty time shall be compensated at the rate of time and one‐half their normal rate of pay for a minimum of three (3) hours. Said employee shall be required to assign any court fees received to Town of Auburn.
Court Pay. Parking Enforcement Officers who are required, in the course and scope of their official employment, to appear in court or other official hearings other than during his/her work week schedule, shall receive a minimum of four hours pay if that appearance is on a scheduled day off. If a court appearance is required on a scheduled work day, and such appearance commences one half (1/2) hour after completion of an employee’s shift, then the employee shall be compensated at the overtime rate for actual time spent, beginning at the conclusion of the regular shift hours and ending upon his/her release from the court or hearing office.
Court Pay. A covered member who is required by the City to be in court or to attend any pre‐trial conference while off duty shall receive, at the covered member’s time and one‐half (1 ½) hourly rate of pay, the greater of the time the employee actually works on a given day or minimum compensation of two (2) hours. A covered member is eligible to receive two (2) hours of minimum court pay compensation more than once for a given day, if there is an uncompensated period of time in between the two (2) court calls.
