Countrywide at its sole expense shall prepare and serve on the appropriate official(s) all notices required by 28 U.S.C. § 1715(b) and CAFA within ten (10) days after the Settlement is filed with the Court.
This Agreement constitutes the full, complete and entire understanding, agreement and arrangement of and between the Named Plaintiffs and the Countrywide Settlement Class Members on the one hand and Countrywide on the other hand with respect to the Settlement and the Released Claims against the Released Persons.
To the extent any such Countrywide Settlement Class Member intervenes, such Countrywide Settlement Class Member shall be bound by this Agreement and will be entitled to receive only a pro rata payment from the Net Distributable Settlement Fund.
The Releasors shall not include any of the following: (a) any members of the Countrywide Settlement Class who timely opt out of the Settlement in accordance with Paragraph 9 below; (b) any persons not identified on Exhibit D, attached; or (c) the Non-Countrywide Plaintiff Borrowers.
The Parties agree that the Released Persons will suffer irreparable harm if any Countrywide Settlement Class Member takes action inconsistent with this Paragraph 6.a, and that, in such event, the Released Persons may seek an injunction as to such action without further showing of irreparable harm.
