Construction Fencing definition

Construction Fencing is temporary fencing constructed for the purpose of preventing livestock from entering the Leased Premises during the time of Initial Construction. Within a reasonable time after completion of the construction of the structures on the Leased Premises, Landlord and Tenant each shall have constructed the fences for which they are respectively responsible (as described immediately below in this Section 4.1) and as set forth in Exhibit A3. The preceding sentence does not require Tenant to wait until after completion of the construction of structures to commence construction of fences. Tenant shall be responsible for constructing, repairing, maintaining and replacing as reasonably necessary the fence structures in the locations depicted in Exhibit A3 as “Tenant’s Wood Screening Fence or Steel Security Fence.” Landlord shall be responsible for constructing, repairing, maintaining and replacing as reasonably necessary the fence structures in the locations depicted in Exhibit A3 as “▇▇▇▇▇▇▇▇’▇ Barbed Wire Cow Fence.” Upon removing Construction Fencing from an area, Tenant shall restore such area back to pre-Construction Fencing condition. The Initial Construction and any improvements on the Leased Premises shall, at no time, prevent cattle from having access to tree shade except as Landlord may permit or as set forth elsewhere herein. Landlord and Tenant understand and agree livestock will have access to the portions of parcels ▇▇▇-▇▇▇-▇▇ and ▇▇▇-▇▇▇-▇▇ outside the Construction Fencing/permanent fencing areas, including all tree shade area outside the Construction Fencing/permanent fencing areas, whenever pasturing in their designated areas on parcels ▇▇▇-▇▇▇-▇▇ and ▇▇▇▇-▇▇▇-▇▇, except when the areas may be involved in utility infrastructure installation (i.e. trenching), in which case the work will be done in no more than two weeks and the cows’ access to the areas will thereafter resume. Because of pasture rotation, there will be weeks when no animals will be within parcels ▇▇▇-▇▇▇-▇▇ or 155- 121-17. In no event shall the square footage of the Tenant’s Buildings be less than 5,000 gross square feet and no more than 5,680 gross square feet unless otherwise approved by Landlord. Examples of Construction Fencing in a sentence

  • Temporary Construction Fencing shall be supported by metal posts on feet or other, similar means, and shall not be inserted into the ground.

  • The Contractor shall insure that all Temporary Construction Fencing and screening is correctly anchored in place, with a special review procedure in place when excessive/high winds are anticipated.
