Confidentiality Period means, (A) with respect to Confidential Information (other than trade secrets), during the term of the Service Term and for a period of one (1) year after termination of the Service Term, and (B) with respect to trade secrets, during the term of the Service Term and for such period thereafter as the information in question falls within the definition of trade secrets under prevailing law.

In the case of trade secrets disclosed orally or in a manner that cannot be marked, such trade secrets must clearly be described as trade secrets at the time of disclosure and shall remain Confidential Information through the Five Year Confidentiality Period; thereafter, such trade secrets shall remain Confidential Information only if Disclosing Party has summarized and identified them as trade secrets in writing to Receiving Party prior to the expiration of the Five Year Confidentiality Period.

Confidentiality Period means the period beginning on the date hereof and ending on the third anniversary of the Termination Date.
