Confidentiality Designation definition

Confidentiality Designation means the legend affixed to Documents or ESI for confidential or highly confidential information as defined by, and subject to, the terms of the order concerning confidentiality agreed to and/or entered by the Court in this litigation.

  • Inadvertent production, mistaken production, or in camera review of any document or information without the appropriate Confidentiality Designation, or with the incorrect Confidentiality Designation, will not be deemed to waive a later claim to its Confidential or Highly Confidential nature or preclude the Producing Party from designating said document or information as Confidential Information or Highly Confidential Information at a later date.

Confidentiality Designation means the legend affixed to Documents for Confidential Discovery Material as defined by, and subject to, the terms of the Protective Order in this Litigation.
