Only those COSTARS Purchasers registered with DGS may participate as COSTARS Purchasers in a Commonwealth contract.
The Contractor must certify, in writing, for itself and all its subcontractors, that as of the date of its execution of any Commonwealth contract, that neither the Contractor, nor any subcontractors, nor any suppliers are under suspension or debarment by the Commonwealth or any governmental entity, instrumentality, or authority and, if the Contractor cannot so certify, then it agrees to submit, along with the bid/proposal, a written explanation of why such certification cannot be made.
The Contractor must also certify, in writing, that as of the date of its execution of any Commonwealth contract, it has no tax liabilities or other Commonwealth obligations.
If, in the opinion of the Commonwealth, contract negotiations with the selected party cannot be concluded within 60 days following the selected party's receipt of a draft lease agreement, the Commonwealth may at its sole discretion, immediately discontinue negotiations with the selected party and commence negotiations with any other interested party.
The selected offeror and each SDB listed on the SDB Utilization Schedule and VBE listed on the VBE Utilization Schedule must enter into a final, definitive subcontract agreement signed by the selected offeror and the SDB or VBE within 30 calendar days of the final execution date of the Commonwealth contract .
If the selected offeror and an SDB listed on the SDB Utilization Schedule or VBE listed on the VBE Utilization Schedule cannot agree upon a definitive subcontract within 30 calendar days of the final execution date of the Commonwealth contract or as specified in the solicitation, the selected offeror must provide written notification to the issuing Agency and BDISBO.

The Commonwealth has developed a set of minimum Service Level Agreements (SLA’s), defined in Attachment G, which the awarded Contractor must meet in order to be in good standing on the contract.The contract administrator shall be notified promptly should a dispute arise in a performance issue.The SLA’s will be reviewed by the Commonwealth contract administrator to identify any issues requiring attention, and will be reviewed, during any meetings between the Commonwealth and the Contractor.
The selected supplier(s) will be expected to execute the terms of a standard Commonwealth contract (see Attachment B, example), considered to be an official Cheyney University contract.
