Common Area Maintenance Expenses definition

Common Area Maintenance Expenses means all expenses (other than the Tax and Insurance Expenses described above) incurred by Landlord for the maintenance, repair, and operation of the Building, (excluding only structural soundness of the roof, foundation and exterior walls) including, but not limited to, management fees, utility expenses (if not separately metered), maintenance and repair costs, sewer, landscaping, trash and security costs (if furnished by Landlord), wages and fringe benefits payable to employees of Landlord whose duties are connected with the operation and maintenance of the Building, amounts paid to contractors or subcontractors for work or services performed in connection with the operation and maintenance of the Building, all services, supplies, repairs, replacements or other expenses for maintaining, repairing, and operating the Building, including without limitation common areas and parking areas and roof, exterior wall and foundation work that is not related to structural soundness.
Common Area Maintenance Expenses shall not include repair, restoration or other work occasioned by fire, windstorm or other casualty with respect to which Landlord actually receives insurance proceeds, income and franchise taxes of Landlord, expenses incurred in leasing to or procuring of tenants, leasing commissions, advertising expenses, expenses for the renovating of space for new tenants, interest or principal payments on any mortgage or other indebtedness of Landlord, compensation paid to any employee of Landlord above the grade of building superintendent, or depreciation allowance or expense.
Common Area Maintenance Expenses means the costs and expenses of operating and maintaining the Common Area.

Examples of Common Area Maintenance Expenses in a sentence

  • As expenses included in Common Area Maintenance Expenses, Landlord will be responsible for landscaping and maintenance of common areas and parking areas, exterior painting, and common sewage line plumbing.

  • All costs and expenses incurred by Landlord under this Section 6.1 shall be included in Common Area Maintenance Expenses, other than costs and expenses for Landlord's correction of defects in Landlord's Work.

  • Prior to the proration of such Common Area Maintenance Expenses to Tenant, there shall be deducted from the total of such Common Area Maintenance Expenses any amounts specifically contributed by the Major Tenants toward such Common Area Maintenance Expenses.

Common Area Maintenance Expenses means any and all expenses (other than the Tax and Insurance Costs described above) arising from the maintenance, repair, replacement and operation of, and modifications and improvements to comply with governmental mandate to, the Project's common areas and any portions of the Project for which Landlord is responsible hereunder (excluding only expenses associated with structural integrity of the roof, foundation, and exterior walls) including, but not limited to, management fees, utility expenses (if furnished by Landlord), wages and fringe benefits payable to employees of Landlord whose duties are connected with the operation and maintenance of the Project, amounts paid to contractors or subcontractors for work or services performed in connection with the operation and maintenance of the Project, including without limitation common areas and parking areas and roof, exterior wall and foundation work that is not related to structural integrity. Any capitalized expenditures included within the foregoing (together with reasonable finance charges) will be amortized for purposes of this Paragraph over a three (3) year period.
Common Area Maintenance Expenses. (as defined in the Master Lease) for the Subleased Premises.
Common Area Maintenance Expenses means all expenses of any kind or nature which are necessary, ordinary or customarily incurred with respect to the operation, repair and maintenance of the Building, and the lot on which the Building is situated, as determined in accordance with generally accepted accounting principles and shall include, but not be limited to, all sums expended in connection with Common Areas for all general operation and maintenance and repairs, resurfacing, or painting, restriping, cleaning and sweeping; maintenance and repair of sidewalks, curbs, sprinkler systems, planting and landscaping; water, lighting and other utilities; maintenance and repair of any fire protection systems, lighting systems, storm drainage systems, roof patching and any other utility systems; personnel to implement such services; personal property taxes and assessments on the improvements comprising said Common Areas; and governmental imposition or surcharge imposed against Landlord or assessed against the automobile parking area or any other portion of the Common Areas; depreciation on maintenance and operating machinery and equipment (if owned) and rental paid for such machinery and equipment (if rented). In addition, Tenant shall pay a sum to Landlord for the accounting, bookkeeping and collection of the expenses in connection with said Common Areas in an amount equal to ten percent (10%) of Tenant’s pro rata share of the total of the aforementioned expenses for each calendar year. The amount payable by Tenant for any repair that exceeds $10,000 shall be pro-rated over the useful life of the repair. Tenant shall only be required to pay its pro-rata share of the cost divided by the useful life, as determined in accordance with generally accepted accounting principles, multiplied by the remaining lease term, including the Renewal Period if Tenant has exercised its option to renew the lease. As an example, if a repair costs $20,000 and there are two years remaining on the lease term and the repair has a useful life of ten years, Tenants share would be calculated as follows: Repair cost $20,000 Useful life 10 years Remaining term 2 years $20,000/10 = $2,000 times 2 years = $4,000 Tenant’s share $4,000 times 34.3% = $1,372
Common Area Maintenance Expenses means all costs and expenses paid or incurred by Landlord, or for which Landlord is obligated, during each Operating Year, with respect to the repair, replacement, restoration, maintenance and operation of the land and building of which the demised premises forms a part (sometimes hereinafter referred to as the “Property”), including, without limitation, all areas (“Common Areas”) of the Property that are available for the common use of the tenants of the Property and that are not leased to any tenant of the Property (e.g., parking areas, driveways, sidewalks, loading areas, access roads, corridors, landscaping and planted areas). Any additional rent billed Tenant under paragraphs 42nd (c) (ii) and (iii) and 44th below shall be excluded from “Common Area Maintenance Expenses”:
Common Area Maintenance Expenses means all expenses of any kind or nature which are necessary, ordinary or customarily incurred with respect to the operation, repair, maintenance, or replacement of the Common Areas of the Project as determined in accordance with generally accepted accounting principles and shall include, but not be limited to, all sums expended in connection within the Common Areas for all general operation, maintenance, replacement, and repairs, repainting, restriping or resurfacing of parking areas, cleaning, sweeping and janitorial services; sidewalks, curbs, and signs in the Project, sprinkler systems, planting and landscaping; fighting and other utilities; directional signs and other markers and bumpers; maintenance and repair of any lighting systems, storm drainage systems, and any other utility systems; costs of improvements made by Landlord to the Common Areas as mandated by any governmental authority, the cost of any improvements to bring the Common Areas into compliance with those requirements of ADA which are required by changes in existing laws or regulations, and amounts paid to a third party, firm, or corporation (which may be related to landlord) for the management of the Project. Landlord may cause any or all of said services to be provided by an independent contractor or contractors.
Common Area Maintenance Expenses means any or all expenses incurred by Owner in connection with the operation of the Buildings of which the Demised Premises forms a part. Common Area Maintenance Expenses shall include, without being limited thereto, the following: (i) salaries, wages of employees which Owner may engage in the on-site operation and maintenance of BSP; (ii) payroll taxes; workmen's compensation; (iii) water waste line maintenance (including sewer rental) furnished to BSP, together with any taxes on any such utilities; (iv) the cost of all insurance carried by Owner applicable to the Building (including, without limitation, primary and excess liability, and further including vehicle insurance, fire and extended coverage, vandalism and all broad form coverage including, without limitation, riot, strike, and war risk insurance, flood insurance, boiler insurance, plate glass insurance and sign insurance); (v) the cost of all building and cleaning supplies; (vi) the cost of all charges for service contracts with independent contractors for all areas of the BSP; (vii) the cost of landscaping, site maintenance and snow removal (except if Tenant performs snow removal); (viii) taxes (such as sales and use taxes); (ix) security systems, security personnel and any other costs and expenses in connection with the operation, maintenance and repair of BSP. In no event shall the Common Area Expenses be less than $1.50 per sf.
Common Area Maintenance Expenses means all costs and expenses incurred by or on behalf of Landlord in operating, managing, insuring, securing and maintaining the Common Areas pursuant to Subsection 11.2 (excepting Insurance Costs described in Subsection 15.6), including, without limitation, all costs and expenses of operating, maintaining, repairing, lighting, signing, cleaning, painting, striping, policing and security of the Common Areas (including cost of uniforms, equipment and employment taxes); alarm and life safety systems; insurance, excepting Insurance Costs described in Subsection 15.6, but otherwise including, without limitation, liability insurance for personal injury, death and property damage, insurance against loss of rents and other income, worker's compensation insurance or similar insurance covering personnel, fidelity bonds for personnel, insurance against liability for defamation and claims of false arrest occurring on and about the Common Areas; cost of cleaning all exterior glass; removal of water, snow, ice, litter and debris; regulation of traffic; costs and expenses of inspecting and depreciation of machinery and equipment used in the operation and maintenance of the Common Areas and personal property taxes and other charges (including, but not limited to, leasing or rental costs) incurred in connection with such equipment; costs and expenses incurred in making any alterations to the Center required to be made pursuant to Legal Requirements, consistent with the provisions of Subsection 10.4; costs and expenses of maintenance and repair or replacement of roofs, awnings, paving, curbs, walkways, landscaping, drainage, pipes, ducts, conduits and similar items, signage for the Center, and lighting facilities; costs and expenses of planting, replanting and replacing flowers, shrubbery and planters; costs of providing energy to light, heat, ventilate and air condition areas in which the Common Areas are located and the maintenance and repair of such equipment; cost of water services, if any, furnished by Landlord for the non-exclusive use of all tenants; costs and expenses of repairing and maintaining all mains and electrical conduits necessary to provide water, electricity, telephone and sewer service to the Center; roads and storm drainage facilities unless and until dedicated for public purposes; Landlord's share of expenses under any declaration, covenant, condition, restriction or other agreement recorded among the land records of the county in which the Center is ...
