Collateral File definition

Collateral File. With respect to each Mortgage Loan, a file containing each of the Collateral Documents.
Collateral File means, as to each item of Collateral, those documents set forth in a schedule to be delivered by Lender to Custodian and which are delivered to the Custodian pursuant to the terms of this Loan Agreement or the Custodial Agreement including, without limitation, all documents required by Lender to grant and perfect a first priority security interest in such item of Collateral.

  • It is understood and agreed that the representations and warranties set forth in this Section 6 shall survive delivery of the respective Collateral File to the applicable Custodian and shall inure to the benefit of the Assignee and its assigns notwithstanding any restrictive or qualified endorsement or assignment.

More Definitions of Collateral File

Collateral File means a file delivered to the Document Custodian by the Company pursuant to Section 3, containing the Collateral Documents relating to the Collateral, as set forth on the Collateral Schedule delivered to the Document Custodian.
Collateral File means, for each Loan, (a) copies of each of the Required Loan Documents and (b) any other portion of the Loan File which is not part of the Required Loan Documents.
Collateral File. With respect to each Mortgage Loan that is owned by an Agency, a file containing each of the Mortgage Loan Documents or, as applicable, copies thereof, that are required by the applicable Agency to be held by the document custodian pursuant to the Servicing Agreements.

Collateral File means the original Note or, if unavailable, an original lost instrument affidavit or bailee letter, the original or a copy of the recorded Mortgage, the original or copies of all assignments of the Mortgage, and the original or a copy of the title policy referred to in Section 3.04(f).
