City Property Restaurant definition

City Property Restaurant means one (1) restaurant that may operate on a Parcel of the City Property. No portion of the City Property shall be used for any restaurant use (i) that is substantially similar to any use or type of restaurant being made or operated within the Xxxxx Shopping Center prior to the establishment of the City Property Restaurant; or (ii) that will violate any exclusive use restrictions provided by Xxxxx to any existing or future owner, lessee or tenant of any portion of the Xxxxx Shopping Center (for example, any agreement made by Xxxxx that such party will have the exclusive right to operate any type of restaurant or sell any type of product) (a "Xxxxx Shopping Center Exclusive Use").

For purposes of this part, joint property is considered to consist of a present interest and a future interest. The future interest is the right of survivorship.

These properties or resources may include, but are not limited to, monuments, memorials, Indian habitations, ceremonial sites, abandoned settlements, sunken or abandoned ships, engineering works, treasure trove, artifacts, or other objects with intrinsic historical or archaeological value, or any part thereof, relating to the history, government, and culture of Florida.
