CCAA Order definition

CCAA Order means any Order of the Court made in connection with the CCAA Proceedings and “CCAA Orders” means more than one CCAA Order.
CCAA Order means one or more orders of the Canadian Court providing that:
CCAA Order means the order of the Canadian Bankruptcy Court issued in the CCAA Cases recognizing the Chapter 11 Cases, which order shall be in form, scope and substance satisfactory to the Agents and shall provide for a super priority charge in favor of the Collateral Agent for the benefit of the Lenders on the Canadian Collateral to secure the Obligations, and from which no appeal has been timely filed, or if timely filed, such appeal has been dismissed or denied (unless the Agents waive such requirement), together with all extensions, modifications and amendments thereto, in form, scope and substance satisfactory to the Agents.

  • The Debtors are hereby authorized to continue using cash collateral in the exercise of their powers and subject to the terms of the CCAA Order.

CCAA Order means the Order of the Honourable Mr. Justice Macintosh granted in the CCAA Proceedings on March 5, 2021, as amended and restated, as same may have been further amended, restated, varied or extended from time to time by subsequent Orders;
CCAA Order means one or more orders of the Canadian Court in the CCAA Cases, in form and substance satisfactory to the Subcommittees, under the Canada Business Corporation Act or the CCAA effecting certain elements of the Restructuring Transactions and of this Plan.
CCAA Order means the order of the Canadian Bankruptcy Court in form, scope and substance satisfactory to the Administrative Agent and the Majority Lenders approving the Canadian Case, including, if applicable, an initial order of the Canadian Bankruptcy Court in connection with full CCAA proceedings of Foamex Canada.

CCAA Order means each of the Initial Order entered in the CCAA Cases on or about October 20, 2004, and such other order relating thereto (in each case in form and substance satisfactory to Agent and Lenders) authorizing, among other things, (i) the recognition of the Chapter 11 Cases, the Interim Financing Order and all other orders entered by the Bankruptcy Court in the Chapter 11 Cases that are necessary to authorize and implement the terms of the Financing Agreements, (ii) imposing a stay of proceedings in Canada against the Debtors, their assets, properties and undertakings, (iii) that the stay of proceedings in the CCAA Cases shall not apply to Agent and Lenders, (iv) that the commencement and continuation of the CCAA Cases shall not apply to prevent Agent and Lenders from exercising all their rights and remedies under the terms of the Ratification Agreement, the other Financing Agreements and the Financing Order, and (v) the authorization of Canadian Borrower and Canadian Guarantors to execute and deliver and enter into, comply with, perform and be bound by all of the terms and provisions set forth in the Loan Agreement, the other Financing Agreements and the Financing Order.
CCAA Order means the initial order that either the CCAA Court has entered or that Canadian Borrower has requested that the CCAA Court enter in the CCAA Case on or about June 10, 2009 and such other order relating thereto (in each case in form and substance satisfactory to Agent and Lenders) authorizing, among other things, (i) imposing a stay of proceedings in Canada against Canadian Borrower, its assets, properties and undertakings, (ii) that the stay of proceedings in the CCAA Case shall not apply to Agent and Canadian Borrower, (iii) that Agent and Canadian Lender shall be unaffected creditors in the CCAA Case, (iv) the authorization of Canadian Borrower to execute and deliver and enter into, comply with, perform and be bound by all of the terms and provisions set forth in the Forbearance Agreement, and (v) authorizing the extension of credit by Agent and Canadian Lender to Canadian Borrower.
CCAA Order means the order or orders of the Canadian Court in the CCAA Proceedings under the CCAA and/or the CBCA approving and/or effecting certain elements of the Restructuring Transactions, the Plan and the Plan Supplement.
