The Cayman Court shall have entered the Cayman Order in form and substance reasonably acceptable in all material respects to the Debtors.
On August 30, 2012, the Cayman Court approved the JPLs’ entry into the Cross Border Protocol, and on September 11, 2012, the Bankruptcy Court entered an order authorizing AIHL to execute the Cross Border Protocol [Docket No. 471].

On March 20, 2012, the Cayman Court entered an order (the “Commencement Order”) enjoining creditors from taking actions against AIHL in the Cayman Islands, appointing Gordon MacRae and Simon Appell of Zolfo Cooper (Cayman) Limited as joint provisional liquidators of AIHL (the “JPLs”) pursuant to s.104(3) of the Cayman Companies Law (2011 Revision), and also staying the winding-up of AIHL.
The Application was heard by the Cayman Court on 19 July 2016 and the Cayman Court granted the Court Order sought in the Application to appoint the JPLs who are authorised to develop and propose the Debt Restructuring in accordance with their powers conferred by the Court Order, which are limited to the Company itself rather than the Company’s subsidiaries.
