Category A Defect means the most severe Defect, such as when:

Category A Defect means the most serious error manifested by the fact that: the delivered Work or any Stage thereof shows legal defects, or the Work or any Stage thereof does not have the properties expressly referred to in this Contract or specified in the Documentation, or the delivered Work or any Stage thereof is completely non-functional or excludes the use of the System as a whole. For the avoidance of doubts, the Parties have agreed that overall non-functionality of the Software and/or Hardware (3 and more kiosks at the same time), preventing the use of the System, shall be regarded as a Category A Defect.
