Buy-Down Agreement definition

Buy-Down Agreement. An agreement governing the application of Buy-Down Funds with respect to a Buy-Down Mortgage Loan.
Buy-Down Agreement means a written agreement between any of the Borrowers and a Lender setting forth the terms and conditions under which such Lender has agreed to credit against interest otherwise payable to such Lender on account of Loans outstanding hereunder certain amounts calculated based upon Available Deposits maintained by any of the Borrowers with such Lender.

  • Upon termination of a Buy-Down Agreement, no further Buy-Down Funds relating thereto shall be deposited into the Servicer Custodial Account, and the Servicer may withdraw the related Buy-Down Funds which remain in the Buy-Down Account and distribute such funds as provided by such Buy-Down Agreement.

  • With respect to each Buy-Down Mortgage Loan, on the Business Day next following receipt of the Mortgagor's required monthly payment under the related Buy-Down Agreement, the Servicer shall withdraw from the Buy-Down Account and deposit in immediately available funds in the Servicer Custodial Account an amount which, when added to such Mortgagor's payment, will equal the full monthly payment due under the related Mortgage Note.

  • Credit Enhancement Agreement and Interest Buy-Down Agreement Only - The applicant sells the bonds on the open market and notifies the Board of the terms of sale.

  • Interest Buy-Down Agreement means any agreement entered into between the Board, on behalf of the State, and a political subdivision, for the purpose of reducing the cost of financing incurred by a political subdivision on bonds issued by the subdivision for project costs.

  • The Borrowers shall pay all interest, and any deficiency fees or other amounts payable under their Buy-Down Agreement with each Buy-Down Lender, directly to such Buy-Down Lender within two Business Days of receipt of a billing statement from such Buy-Down Lender.
