Business Associate’s Agents. To ensure that any agents, including subcontractors, to whom Business Associate provides PHI received from or created or received by Business Associate on behalf of County, agree to the same restrictions and conditions that apply to Business Associate with respect to such PHI, including implementation of reasonable and appropriate administrative, physical, and technical safeguards to protect such PHI; and to incorporate, when applicable, the relevant provisions of this Addendum into each subcontract or subaward to such agents or subcontractors.

Business Associate’s Agents. Business Associate shall ensure that any agents, including sub Providers, to whom Business Associate provides PHI received from (or created or received by Business Associate on behalf of) Covered Entity agree to the same restrictions and conditions that apply to Business Associate with respect to such PHI. In addition, Business Associate shall ensure that any agent, including a sub Provider, to whom it provides ePHI received from Covered Entity agrees to implement reasonable and appropriate safeguards to protect it.
Business Associate’s Agents. In accordance with 45 CFR 164.502(e)(1)(ii) and 164.308(b)(2), if applicable, Business Associate shall ensure that any Subcontractors that create, receive, maintain, or transmit Protected Health Information on behalf of the Business Associate, agree to the same restrictions, conditions, and requirements that apply to the Business Associate with respect to such information.

To provide access as [DEPT ACRONYM] may require, and in the time and manner designated by [DEPT ACRONYM] (upon reasonable notice and during Business Associate’s normal business hours) to PHI in a Designated Record Set, to [DEPT ACRONYM] (or, as directed by [DEPT ACRONYM]), to an Individual, in accordance with 45 C.F.R. § 164.524. Designated Record Set means the group of records maintained for [DEPT ACRONYM] that includes medical, dental and billing records about individuals; enrollment, payment, claims adjudication, and case or medical management systems maintained for [DEPT ACRONYM] health plans; or those records used to make decisions about individuals on behalf of [DEPT ACRONYM]. Business Associate shall use the forms and processes developed by [DEPT ACRONYM] for this purpose and shall respond to requests for access to records transmitted by [DEPT ACRONYM] within fifteen (15) calendar days of receipt of the request by producing the records or verifying that there are none.
Business Associate’s Agents. Business Associate shall ensure that any agent, including a subcontractor, to whom it provides any PHI received from Cisco agrees to the same restrictions and conditions that apply through this Attachment to Business Associate with respect to such PHI.

If any agents or subcontractors of the Business Associate are not subject to the jurisdiction or laws of the United States, or if any use or disclosure of PHI in performing Services will be outside of the jurisdiction of the United States, such entities must agree by written contract with the Business Associate to be subject to the jurisdiction of the Secretary, the laws and the courts of the United States, and waive any available jurisdictional defenses as they pertain to the partiesobligations under this Agreement, the Privacy Rule or the Security Rule.
Business Associate’s Agents. To the extent that Business Associate uses one or more subcontractors or agents to provide services under the Underlying Agreement, and such subcontractors or agents receive or have access to PHI, Business Associate shall sign an agreement with such subcontractors or agents containing substantially the same provisions as this BA Agreement.
