Definition of Building Rentable Area


Building Rentable Area means approximately 60,814 square feet, which is all the rentable space available for lease in the Building. If there is a significant change in the aggregate Building Rentable Area, of a permanent nature, as a result of an addition to the Building, partial destruction thereof or similar circumstance, Landlord's space planner or architect shall determine and make an appropriate adjustment to the provisions herein. Unless otherwise provided herein, any statement of square footage set forth in this Lease or that may have been used in calculating Rent and/or Tenant's Pro Rata Share of Operating Expenses is an approximation which Landlord and Tenant agree is reasonable, and the Rent and Tenant's Pro Rata Share based thereon is not subject to revisions during the Primary Lease Term whether or not the actual square footage is more or less.

ADDITIONAL RENT 8DEFINITIONS: As used in this Article 8, the words and terms which follow mean and include the following: -7- 8 (a) "LESSEE'S PROPORTIONATE SHARE" shall mean a fraction having as numerator the Rentable Area and having as denominator the Building Rentable Area as stated in Exhibit 2.
In determining the amount of Operating -30- 36 Expenses for any Operating Year, if less than ninety-five percent (95%) of the Building Rentable Area shall have been occupied by tenant(s) at any time during such Operating Year, Operating Expenses shall be determined for such Operating Year to be an amount equal to the Operating Expenses which would normally be expected to have been incurred had such occupancy been ninety-five percent (95%) throughout such Operating Year.
Notwithstanding the estimates shown in the Lease Summary, Landlord shall calculate the Premises Rentable Area and Building Rentable Area and the Tenants Share upon completion of construction and shall provide the calculations to Tenant.
Bankruptcy Code: As defined in Section 13.1. Building Rentable Area: 308,496 rentable square feet.
Escalation Charges: The amounts prescribed in Sections 8.1 and 9.2. Escalation Factor Computation: Premises Rentable Area divided by Building Rentable Area.
