All other Authorized Products and Services (i.e., those which are not Proprietary Authorized Products and Services) are optional, and Franchisee does not have to offer them for sale at Franchisee’s Center.
If in the future ASE or MECP certification is offered on Authorized Products and Services that is not offered as of the Agreement Date, or if in the future Franchisee performs Authorized Products and Services for which ASE or MECP certification is offered, Franchisee agrees to obtain such certification within a reasonable period of time, not to exceed 1 year.
The Authorized Products and Services within each of the categories include service, installation, repair, and maintenance and all products relating thereto and the sale of any such products, and Franchisor’s determination with respect to any item which may fall within one or more categories shall be final and binding.
We have the right to add to, and otherwise modify, the Operation Manual to reflect changes in Authorized Products and Services, as well as changes in specifications, standards and operating procedures of a TINT WORLD® Center.
Franchisee must offer for sale and exert Franchisee’s best efforts to aggressively market and sell all “Proprietary Authorized Products and Services” listed in the Operations Manual, which currently are automotive; window tinting, alarms, audio/visual, detailing, and accessories and any other Authorized Products and Services that we designate from time to time to be products or services central to the operation of Tint World® Businesses.
Franchisor may add or delete Authorized Products and Services and conditionally approve Authorized Products and Services.
Franchisor may add Proprietary Authorized Products and Services once the sales of the products or services reach 10% of the system-wide sales for one year.
Franchisee may not enter into any agreement, understanding or arrangement, or engage in any concerted practice, with other Tint World® franchisees or others relating to the prices at which Authorized Products and Services are offered or sold by Franchisee or any other Tint World® Business.
Franchisee’s Business may not, without Franchisors approval, offer any products and services that are not Authorized Products and Services.
Franchisor may delete Proprietary Authorized Products and Services once the sales of the product or service drops below 10% of the system-wide sales for one year.
