audio and audiovisual content service means a service where the principal purpose of the service or a dissociable section thereof is devoted to providing audio/audiovisual programming to inform, entertain and educate the public and is conveyed using the broadcasting services radio frequency bands or distributed over electronic communications networks and is under the editorial responsibility of a recognised natural or juristic person

Affiliate of any specified Person means any other Person directly or indirectly controlling or controlled by or under direct or indirect common control with such specified Person. For the purposes of this definition, “control” when used with respect to any specified Person means the power to direct the management and policies of such Person, directly or indirectly, whether through the ownership of voting securities, by contract or otherwise; and the terms “controlling” and “controlled” have meanings correlative to the foregoing.
Contract means the agreement that results from the acceptance of a bid by an organ of state;
Agreement has the meaning set forth in the preamble.
Company means the Person named as the “Company” in the first paragraph of this instrument until a successor Person shall have become such pursuant to the applicable provisions of this Indenture, and thereafter “Company” shall mean such successor Person.
Code means the Internal Revenue Code of 1986, as amended.
Director means a member of the Board.
Employee means any person, including Officers and Directors, employed by the Company or any Parent or Subsidiary of the Company. Neither service as a Director nor payment of a director’s fee by the Company will be sufficient to constitute “employment” by the Company.
Person means any individual, corporation, limited liability company, partnership, joint venture, association, joint-stock company, trust, unincorporated organization or government or any agency or political subdivision thereof.
Subsidiary means a “subsidiary corporation,” whether now or hereafter existing, as defined in Section 424(f) of the Code.
Board means the Board of Directors of the Company.
Business Day means any day except any Saturday, any Sunday, any day which is a federal legal holiday in the United States or any day on which banking institutions in the State of New York are authorized or required by law or other governmental action to close.
Act when used with respect to any Holder, has the meaning specified in Section 104.
Department means the department of natural resources.
Commission means the Securities and Exchange Commission.
Internet service means a service that enables users to access proprietary and other content,
IntraLATA LEC Toll means IntraLATA Toll traffic carried solely by a Local Exchange Carrier and not by an IXC.
Verizon OSS Information includes, but is not limited to: (a) any Customer Information related to a Verizon Customer or a Reconex Customer accessed by, or disclosed or provided to, Reconex through or as a part of Verizon OSS Services; and, (b) any Reconex Usage Information (as defined in Section 8.1.6 below) accessed by, or disclosed or provided to, Reconex.
Customer Content means any and all data, applications, files, information or materials accessed, transmitted, uploaded, published or displayed through the Software or Hosted Service by You, Your Users or any third party users and/or their Devices. It does not include Relationship Data or Usage Data.
Video service means video programming, cable services, IPTV, or OVS provided through facilities located at least in part in the public rights-of-way without regard to delivery technology, including internet protocol technology. This definition does not include any video programming provided by a commercial mobile service provider defined in 47 USC 332(d) or provided solely as part of, and via, a service that enables users to access content, information, electronic mail, or other services offered over the public internet.
User Content means any communications, sounds, images, and all the material, data, and information that you upload or transmit to the Services, or that other users upload or transmit, including without limitation, any chat text. By transmitting or submitting any User Content while using the Services, you affirm, represent and warrant that such transmission or submission is (a) accurate and not confidential or misleading; (b) not in violation of any laws, contractual restrictions or other third party rights, and that you have permission from any third party whose personal information or intellectual property is comprised in the User Content; (c) free of viruses, spyware, adware, worms or other malicious code; and (d) you acknowledge and agree that any of your personal information within such content will at all times be processed by Prospectors in accordance with its Privacy Policy.
Internet Service Provider (ISP means an Enhanced Service Provider (ESP) that provides Internet Services.
Internet Service Provider (ISP) is an Enhanced Service Provider that provides Internet Services, and is defined in paragraph 341 of the FCC’s First Report and Order in CC Docket No. 97-158.
VOC content means the total weight of VOC in a product expressed as a percentage of the product weight (exclusive of the container or packaging), as determined pursuant to sections 94515(a) and (b).
