Assistance Costs definition

Assistance Costs means reasonable and necessary legal fees and expenses charged to the Insureds by Lehr Middlebrooks Vreeland & Thompson, P.C., to which Underwriters consent in advance, in assisting the Insureds in investigating or mitigating any Work-Related Fatality or Serious Work-Related Incident, but shall not include:
Assistance Costs means any direct material costs, equipment costs, equipment rental fees, fuel, and the labor costs that are incurred by the Responder in providing any asset, service, or assistance requested.

Assistance Costs shall include third party expenses, including without limitation attorneys’ fees and claims adjustment expenses, paid in connection with investigating, preparing, or pursuing recoveries from insurance contracts and retroactive or prospective premium increases to the extent (and only to the extent) attributable to losses incurred in connection with the Group following the Closing.
