Asbestos Insurance Policy definition

Asbestos Insurance Policy means any insurance policy issued to or for the benefit of any of the Debtors (except for any insurance policy issued to ABI, American Biltrite International Inc., or any of their predecessors) in effect at any time on or before the Effective Date that may afford any of the Debtors indemnity or insurance coverage, upon which any claim has been or may be made with respect to any Asbestos Claim.

Asbestos Insurance Policy means any insurance policy under which any Debtor or Affiliate of the Debtors has or had indemnity, defense, or other insurance coverage, whether known or unknown, that actually or potentially provides insurance coverage for any Asbestos Claim, including but not limited to the policies listed on Exhibit E in the Exhibit Book.

Asbestos Insurance Policy means an insurance policy issued by an Asbestos Insurance Company.

Examples of Asbestos Insurance Policy in a sentence

• The rights of insurers shall be determined under the applicable Asbestos Insurance Policy or any Asbestos Insurance Settlement Agreement with respect thereto.

• The rights of any Asbestos Insurance Company or any such policyholder shall be determined under the applicable Asbestos Insurance Policy or Asbestos Insurance Agreement.

• Nothing in this Plan, any of the Plan Documents, or the Confirmation Order (including any other provision that purports to be preemptory or supervening), shall in any way operate to impair, or have the effect of impairing, the legal, equitable or contractual rights, if any, of any Asbestos Insurance Entity or any policyholder, including the Debtors or their Affiliates, under any Asbestos Insurance Policy or Asbestos Insurance Agreement.

• The TDP recognizes that estimates of liabilities and the value of assets fluctuate over time and, accordingly, applies a “Payment Percentage” to the liquidated value of allowed Asbestos PI Claims other than a claim involving Other Asbestos Disease (Disease Level I- Cash Discount Payment) and Asbestos Premises Liability Claims covered by an applicable Asbestos Insurance Policy.

Asbestos Insurance Policy means any insurance policy under which any Insurance Contributor has or had insurance coverage with a policy period incepting prior to June 30, 1985, whether known or unknown, that actually or potentially provides insurance coverage for any Asbestos Claim, including the policies listed on schedule 1 attached to Exhibit 6 in the Exhibit Book; provided that an Asbestos Insurance Policy shall not include any rights or obligations under any insurance policy or settlement agreement to which any of the Debtors are a party to the extent, but only to the extent, that such rights or obligations pertain solely to coverage for Workers’ Compensation Claims.

Asbestos Insurance Policy means any insurance policy that provides or may provide coverage for claims arising from or related to asbestos-related Claims, remedies, liabilities, or Demands, whether products or premises, and that are or may become available to provide such coverage as a result of the resolution of any Avoidance Actions against any Asbestos Insurance Company, including those policies listed in Exhibit 8 to the Plan, as such exhibit may be amended or supplemented from time to time.

Asbestos Insurance Policy means any insurance policy that provides or may provide coverage for claims arising from or related to asbestos-related Claims, remedies, Liabilities and Demands, whether products or premises, and that are or may become available to provide such coverage as a result of the resolution of any Avoidance Actions against any Asbestos Insurance Company.

Asbestos Insurance Policy means any insurance policy, whether known or unknown, including the policies listed on the schedule attached as Exhibit 10 in the Exhibit Book, that actually or potentially provides insurance coverage for any Asbestos Claim; provided that an Asbestos Insurance Policy shall not include any rights or obligations under any insurance policy or settlement agreement to which any of the Debtors are a party insofar as the insurance policy or settlement agreement relates to Workers' Compensation Claims.

Asbestos Insurance Policy means the insurance policies maintained by any of the Borrowers or any of their respective Domestic Subsidiaries with respect to which any such Borrower or Subsidiary is entitled to (or claims entitlement to) insurance coverage in connection with claims made against any such Borrower or such Subsidiary (or any of their predecessors) for asbestos related injury or alleged injury.

Asbestos Insurance Policy means any insurance policy issued for a policy period at any time before the Effective Date which names the Debtor (or any predecessor, subsidiary, or past or present Affiliate of the Debtor) as an insured, or which otherwise provides or may provide the Debtor with insurance coverage, and which provides or may provide insurance coverage for or with respect to any Asbestos Claim (including without limitation the policies included in the Asbestos Insurance Collateral); provided, however, that Asbestos Insurance Policy does not include any insurance policy if, and then only to the extent that, such policy applies to a period on or after the Effective Date.

Asbestos Insurance Policy has the meaning ascribed to such term in the Credit Agreement.
