If the estimated time needed exceeds nine (9) months from the Architect's Certification, or if the restoration would begin during the last twelve (12) months of the Lease, then in the case of the Premises, either Landlord or Tenant may terminate this Lease, and in the case of the Building, Landlord may terminate this Lease, by notice to the other party within ten (10) days after the notifying party's receipt of the architect's certificate.
The Architect's Certification described in this SECTION 3.1(a)(i)(B)(1) shall assume all space set forth on the Final Plans and Specifications is actually built.
In the event that such restoration is not completed for any reason within twelve (12) months following the Architect's Certification, Tenant shall have the right to terminate this Lease upon ten (10) days' written notice to Landlord, except to the extent that such failure is due to delays attributable to the acts or omissions of Tenant.
If a fire or other casualty causes substantial damage to the Building or the Premises, Landlord shall engage a registered architect to certify within one (1) month of the casualty to both Landlord and Tenant the estimated amount of time needed to restore the Building and the Premises to tenantability, using standard working methods (the "Architect's Certification"').
This notification shall contain a Landscape Architect's Certification of Compliance Letter, signed and sealed by a Registered Landscape Architect.
Owner shall have received satisfactory evidence that the Work and the Project are progressing as indicated in each Requisition and Architect's Certification, including, if so requested by Owner, evidence of satisfactory completion of any required inspections of any Governmental Agencies having jurisdiction over the Property, the Project or the Facility.
Notwithstanding any other term in this SECTION 3.1(a)(i)(B) to the contrary, it is acknowledged and agreed that, except as permitted pursuant to SECTION 1.1(a)(ccxl) hereof (the definition of Project), for the purpose of calculating PILOT, no Architect's Certification submitted under this SECTION 3.1(a)(i)(B) shall reduce the number of Taxable Square Feet to fewer than 1,380,000.
