  • Additionally, APPLIED may develop error corrections, additions and improvements to the program features and functions, and sequential versions to the Applied Software (“Updates”).

  • ACN is an industry user association for licensees of the Applied Software, and organizes and conducts periodic meetings and conference for both its general membership as well as its smaller individual regional and local Chapters.

  • ACN, Chapter, and Presenter shall disclose the Applied Software or related information only to those of their Employees with a need to know and who are contractually obligated under terms no less restrictive than those in this Agreement to keep the Applied Software and related confidential, and not to use the Applied Software and related information through any unauthorized means or for any unauthorized purpose.

  • ACN, Chapter, and Presenter hereby agree that APPLIED is in no way responsible for any such difficulties they may experience as a result of attempting to transmit data over the Internet while using the Applied Software, and ACN, Chapter, and Presenter waive any and all claims against APPLIED in connection therewith.

  • For the avoidance of doubt, this license supersedes any click-through agreements contained in the Applied Software.

  • ACN, Chapter, and Presenter will treat the Applied Software and related information in the same manner each treats its own confidential and proprietary information, but not less than is necessary under the circumstances to maintain the confidentiality of the Applied Software and related information.

  • Chapter/Presenter and its Employees will protect the confidentiality of the Applied Software, any related documentation, and any non-public Web Page information to which Chapter/Presenter shall be provided access, and will use and/or disclose the Applied Software and related information only as expressly authorized hereunder and in accordance with the terms of this Agreement.

Related to Applied Software

  • Developed Software means software specifically designed for the Principal under the Contract. Depending how advanced its development is, it may be either a Product or a Service or both.

  • Supported Software means the supported software identified in the Proposal. System means the designated information technology environment in which the Software is to be used. Term means the term of this Agreement specified in clause 2.

  • SAP Software means: (i) any and all software products and Cloud Services licensed to Customer under the License Agreement as specified in software order forms or Cloud Service Order Forms (or other order forms, schedules or appendices as applicable) thereto; (ii) any new releases, updates or versions thereof made available through unrestricted shipment pursuant to the respective support agreement or warranty obligation and (iii) any complete or partial copies of any of the foregoing.

  • Customized Software or “Customization” means any Application Software code modified or amended on behalf of the Customer. Setting of parameters, parameterization or configuration is not a Customization.

  • Embedded Software means one or more software applications which permanently reside on a computing device.
