For purposes of this Agreement a "claimed injury" is one for which either (a) DWC-1 workers' compensation claim form has been filed with the City and Third Party Administrator ("TPA") or (b) an Application for Adjudication of Claim has been filed with the Workers' Compensation Appeals Board ("WCAB").
Should the cost of medical, surgical, or hospital services incurred as a result of any injury sustained by a unit member in the course and scope of employment not be reimbursed by workers’ compensation, health insurance, or other insurance, the Board shall reimburse the unit member for the cost of medical, surgical, or hospital services, provided the Workers’ Compensation Appeals Board (WCAB) sustains the employee’s Application for Adjudication of Claims.
