Definition of All Risks Property Insurance


All Risks Property Insurance means the insurances described in paragraph 2.1 of Part 3 of Schedule 14;

From Final Acceptance through the expiration of the Warranty Period for the relevant Project, Buyer shall maintain All Risks Property Insurance.
The All Risks Property Insurance policy shall meet the following requirements: (a) the policy shall cover all risks of physical loss or damage except as hereinafter provided, including coverage for boiler and machinery (electrical and mechanical breakdown), transit, and off-site storage exposure for an amount equal to the replacement value of the relevant property; and (b) the coverage shall not contain an exclusion for resultant damage caused by faulty workmanship, design or materials.
The basis of the Property Insurance shall be Replacement Cost and the coverage an "All Risks" Property Insurance Policy.
To the extent permitted by law, Tenant waives any claims it may have against Landlord or its officers, directors, employees or agents for business interruption or damage to property sustained by Tenant as the result of any act or omission of Landlord, to the extent typically covered under policies of All Risks Property Insurance.
To the extent permitted by law, Landlord waives any claims it may have against Tenant or its officers, directors, employees or agents for loss of rents (other than Rent) or damage to property sustained by Landlord as the result of any act or omission of Tenant, to the extent typically covered under policies of All Risks Property Insurance.
