AIRLINE’s landed weight for the month shall be determined as the sum of the products obtained by multiplying the Maximum Certificated Gross Landing Weight, as defined in Section 1.0(A)(38) of this Agreement, for each type of AIRLINE’s aircraft by the number of Aircraft Arrivals of each said aircraft during the month.
Airline’s Landing Fees shall be equal to Landing Fee Rate multiplied by the Maximum Landed Weight of Airline’s Revenue Aircraft Arrivals for any given Fiscal Year.
AIRLINE shall pay monthly to AVIATION fees for all Aircraft Arrivals for the preceding month, hereinafter “Landing Fees.” AIRLINE’s Landing Fees shall be determined as the product of the Landing Fee Rate for the period, calculated in accordance with Exhibit D3, and the AIRLINE’s total landed weight for the month.
The Landing Fee rate per one thousand (1,000) pound units of Landed Weight will then be calculated by dividing the Net Airfield Area Requirement by total Landed Weight of Aircraft Arrivals.
As soon as possible following the close of each Fiscal Year, the actual Part 135 and 121 Operator Landing Area Cost shall be ascertained by County for the Fiscal Year based on actual costs and Aircraft Arrivals.
Aircraft Arrivals shall not include any flights that immediately return to the Airport because of mechanical, meteorological, or other precautionary reason, or following required mechanical inspections or repairs performed at the Airport.
The Landing Fee Rate shall be calculated by dividing the Airfield Area Requirement calculated in accordance with paragraph (1) to (5) above by the estimated Total Landed Weight of all Aircraft Arrivals at the Airport for the succeeding Fiscal Year as estimated by the Aviation Commission.
In the event that Airline fails to transmit to City the Activity Report with data necessary to calculate the amount of Landing Fees incurred by Airline and its Affiliate Airlines during said month, City shall compute and ▇▇▇▇ Landing Fees based upon data available as though the Revenue Aircraft Arrivals and other data were the same as during the highest month in the immediately preceding Fiscal Year or in the current Fiscal Year, whichever is higher.
The pro rata Part 135 and 121 Operator share of the above costs shall be equal to the Total Landed Weight of the Part 135 and 121 Operators divided by the Total Landed Weight of all Aircraft Arrivals for the Fiscal Year, as estimated by County.
