  • The Agent shall have received a Loan Notice in accordance with the requirements hereof, which Loan Notice shall include, among other things, certifications as to compliance with the Agreed Budget in accordance with the terms hereof and substantially similar to those set forth in the Agreed Budget Compliance Certificate delivered on the Closing Date pursuant to Section 5.01(b)(iii).
