Affordable Housing Provider means any body or organisation that is permitted by law or other housing provider agreed by the Council and whose main function or aim is to provide and/or manage Affordable Housing including a housing association or housing company or trust registered as a provider with the Homes and Communities Agency or its successor or an alternative provider of Affordable Housing or any company or other body approved by the Homes and Communities Agency for receipt of Social Housing Grant in each case nominated by the Owner and approved in writing by the Council
Affordable Housing Provider means any Housing Provider that owns, master leases, manages, or develops Affordable Housing in the City. Any agent, such as a property management company, that makes tenancy decisions on behalf of the above-described Housing Providers, and any government agency, including, but not limited to, the Berkeley Housing Authority, that makes eligibility decisions for tenant-based rental assistance programs, including, but not limited to, the Section 8 program (42 U.S.C. Section 1437f), shall also be considered an “Affordable Housing Provider".

Should an unreasonable refusal reason be given the Council will enter into negotiations with the Affordable Housing Provider, on behalf of the customer, in order to reach a pragmatic and satisfactory outcome.

Affordable Housing Provider means an owner that provides housing in a building in which at least 80% of the units are restricted to occupancy at an affordable rent or an affordable housing cost for persons and families of low and moderate income as defined in California Health and Safety Code Section 50093. The terms "affordable rent" and "affordable housing cost" shall be as defined in California Health and Safety Code Sections 50053 and 50052.5 and their implementing regulations.
