ADVERSE ENVIRONMENTAL IMPACT definition

ADVERSE ENVIRONMENTAL IMPACT means (i) a Release of a Hazardous Substance in a Reportable Quantity or (ii) any material adverse impact on human health, livestock or the quality of any Property.

THE FUND MAY BE EXPENDED TO INVESTIGATE ALLEGED VIOLATIONS OF ANY PROVISION OF THIS ARTICLE, OR OF ANY RULE, REGULATION, OR ORDER OF THE COMMISSION, OR OF ANY PERMIT WHERE THE ALLEGED VIOLATION THREATENS TO CAUSE OR ACTUALLY CAUSES A SIGNIFICANT ADVERSE ENVIRONMENTAL IMPACT.

Based on the foregoing, the Town Board hereby issues: NOTICE OF DETERMINATION OF NON-SIFNICANCE:NEGATIVE DECLARATIONTHEREFORE, BASED ON THE FOREGOING THE TOWN OF MALONE, AS LEAD AGENCY, HEREBY DETERMINES THAT THE PROPOSED ACTION, A TYPE I ACTION, THE JOINT VILLAGE OF MALONE AND COUNTY OF FRANKLIN SOLAR FARM TO BE LOCATED ON THE CLOSED MALONE MUNICIPAL LANDFILL INVOLVING MORE THAN 10 ACRES WILL NOT HAVE A SIGNIFICANT ADVERSE ENVIRONMENTAL IMPACT AND A DRAFT IMPACT STATEMENT WILL NOT BE PREPARED.
