Adventure Activities definition

Adventure Activities shall include but are not limited to use of skies, snowboards, skiing, climbing, hiking, sightseeing, orientation and instructional courses, seminars and sessions: and other such activities, events and services in any way connected with or related to those activities. I acknowledge that I am required to wear an approved helmet and other safety equipment while participating in certain Adventure Activities. I am aware that there are guides or instructors available to answer any questions that I may have as to the proper use of the equipment. I am aware that the physical exertion required of Adventure Activities and the forces exerted on the body can activate or aggravate pre‐existing physical injuries, conditions or congenital defects. I acknowledge that I should seek medical advice if I know or suspect that my physical condition may be incompatible with Adventure Activities. I am aware that Adventure Activities involve many risks, dangers and hazards including but not limited to: Changing weather conditions, falling tree limbs and ice, falling from platforms, cables and bridges, shock, stress or other injury to body, encounters with wildlife including bears and cougars, equipment malfunction, collision with trees, snowmobiles or other vehicles, equipment or structures, collision with other participants or guides, failure to remain within designated areas, becoming lost or separated from guides or other participants, negligence or other participates or guides and NELIGENCE ON THE PART OF THE RELEASEES, INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF ADVENTURE ACTIVITIES. I am also aware that these risks, dangers and hazards referred to above exist on terrain that may be uncontrolled, unmarked and are not inspected. I AM AWARE OF THE RISKS, DANGERS AND HAZARDS ASSOCIATED WITH ADVENTURE ACTIVITIES AND I FREELY AND VOLUNTARILY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE AND LOSS RESULTING THERE FROM, AND ELECT TO PARTICIPATE IN THE ADVENTURE ACTIVITIES IN SPITE OF SUCH RISKS, DANGERS AND HAZARDS. In consideration of UNIGLOBE Specialty Travel Ltd. DBA Discover Canada Tours, DC Student Adventures, Destination Snow and Club ESL, acting as the intermediary and agent for the Suppliers, I hereby agree as follows:
Adventure Activities shall include all activities, events services provided, arranged, organized, conducted, sponsored or authorized by the Releasees and shall include, but are not limited to: use of rope climbing, zip lines, suspended bridges, ladders, rope swings, cable swings and nets; all travel either within or beyond the designed boundaries, including on all trails; orientation and instructional courses and sessions; and other such activities, events and services in any way connected with or related to Adventure Activities.
Adventure Activities shall include all activities, events or services provided, arranged or organized by the Releasees including, but not limited to: orientation and instruction sessions; surface and air transportation, including all helicopter travel; loading, unloading and travel in or movement around helicopters and watercraft; backcountry travel; multi-day trips and camping; mountaineering; climbing; backpacking; overnight stays in the outdoors; picnicking; fishing; hiking; swimming; use of watercrafts; use of safety equipment including personal floatation devices; accommodation, food, beverage and water supply; and all other activities, events and services in any way connected with or related to these activities.

Adventure Activities shall include but is not limited to: all activities, services and use of facilities and equipment either provided, arranged or organized by the Operator including orientation and instructional sessions or classes, guiding, supervision, transportation, accommodation, food, beverage including water supply, use of equipment, and multi-day camping or overnight stays in the outdoors. In this Release Agreement, the term “Negligence” includes the failure by the Releasees to use such care as a reasonably prudent and careful guide, instructor or operator would use under similar circumstances, or breach of any other duty of care imposed by law. ASSUMPTION OF RISKS Participation in Adventure Activities involves various risks, dangers and hazards including the risk of serious injury, paralysis or death. Adventure Activities often take place in remote wilderness locations, where assistance, medical and first aid services and evacuation may not be readily available and communication may be difficult or not possible. The risks, dangers and hazards that may be encountered include, but are not limited to: slips, trips and falls; impact or collision with objects; encounters with domestic or wild animals including bears and cougars; infectious disease contracted through viruses, bacteria, parasites, and fungi which may be transmitted through direct or indirect contact; negligence of other persons; and NEGLIGENCE ON THE PART OF THE RELEASEES. I UNDERSTAND THAT NEGLIGENCE INCLUDES FAILURE ON THE PART OF THE RELEASEES TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM OR WARN ME OF THE RISKS, DANGERS AND HAZARDS OF PARTICIPATING IN ADVENTURE ACTIVITIES. Please refer to the Operator’s website for further information regarding the risks, dangers and hazards that may be encountered during Adventure Activities. Adventure Activities means any activity, provided by a third-party vendor (e.g. any vendor other than GSEMA), wherein there are known and unanticipated risks, which could result in physical or emotional injury, paralysis, death or damage to the participant, to property, or to third parties, including but not limited to activities such as archery, challenge/obstacle courses or zip-lining, indoor or outdoor rock climbing and rappelling, tubing, downhill or cross-country skiing, snow shoeing, biking, indoor trampolines, white water rafting or boating of any kind, horseback riding or any animal interaction, or similar activities..
Adventure Activities shall include all activities, events or services provided, arranged, organized, conducted, sponsored or authorized by THE RELEASEES and shall include, but are not limited to use of ziplines, suspension bridges, structure and equipment or the activities of climbing, rappelling, hiking, sightseeing, snow shoeing, travel to and from the tour areas, including by ski lifts and gondola, back country travel, orientation and instructional courses, seminars and sessions; and other such activities, events and services in any way connected with or related to those activities, whether taking place before, during or following my participation in the Adventure Activities. ACKNOWLEDGEMENT – SAFETY I acknowledge that I am required to wear an approved helmet and other specified safety equipment, wear adequate sport clothes and keep my hair tightly attached while participating in the Adventure Activities. I am aware that there are guides or instructors available to answer any questions that I may have as to the proper use of the equipment and regarding known risks inherent in the Adventure Activities. I am aware that the Adventure Activities require a good mental, psychological and physical shape and I declare being physically able to participate in these activities. I am also aware that the physical exertion required of Adventure Activities and the forces exerted on the body can activate or aggravate pre-existing physical injuries, conditions, or congenital defects. I acknowledge that I should seek medical advice if I know or suspect that my physical condition may be incompatible with Adventure Activities. I further acknowledge that falling objects pose a serious risk to others and that I will be held responsible for any and all damage or injury caused to property or persons as a result of my dropping, throwing or otherwise releasing any items whatsoever while participating in the Adventure Activities.
Adventure Activities. ’ means any one or more of the fol- lowing activities, that is to say:
Adventure Activities includes all activities, events and services provided, arranged, organized, sponsored or authorized by the Releasees, including but not limited to: canoeing; white water canoeing, kayaking; white water kayaking; surfing; kayak surfing; stand-up paddle boarding; swimming; camping; fire building; knife skills, outdoor and indoor cooking; shelter building; forest survival skills; geocaching; navigation skills; hiking; backcountry travel; trail running; lake, creek and breach explorations; archery; orienteering; orientation and instruction sessions; all related accommodation, transportation or travel; loading and unloading of and transportation by vehicles, rafts, kayaks and canoes; and all related activities.
Adventure Activities shall include but is not limited to hiking, mountain bicycling, kayaking, rafting, swimming, camping, instructional courses, seminars, and sessions, and other such activities, events and services in any way connected with or related to those activities. This includes any and all related transportation provided by Xxxx Xxxxx or a third-party. ACKNOWLEDGEMENT - SAFETY I acknowledge that I have been advised that I am to wear an approved helmet while cycling, a life jacket while involved in water activities, and I am aware that seat belt usage is mandatory. I am also aware that drugs and alcohol are strictly forbidden, and agree to abide by any and all rules, regulations and laws. ASSUMPTION OF RISKS I am aware that adventure activities involve many risks, dangers, and hazards, including, but not limited to accidents which occur during transportation or travel to and from the location of the activity, the overturning or upsetting of kayaks, falling from the craft while on the water, impact or collision with rocks, trees, rafts, bikes, automobiles, falling while climbing, falling while riding, negligence of other participants or the public and NEGLIGENCE ON THE PART OF XXXX XXXXX, INCLUDING THE FAILURE BY XXXX XXXXX TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF ADVENTURE ACTIVITIES. I FREELY ACCEPT AND FULLY ASSUME ALL RISKS, DANGERS, AND HAZARDS ASSOCIATED WITH THE ACTIVITIES AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE OR LOSS RESULTING THEREFROM.
Adventure Activities shall include all activities, events and services provided, arranged, organized, conducted, sponsored or authorized by the Releasees and shall include, but is not limited to: use of zip lines, suspended bridges, ladders, rope swings, bungee cords, cable swings and nets; all travel either within or beyond the designated boundaries, including on logging roads and trails; orientation and instructional courses and sessions; and other such activities, events and services in any way connected with or related to Adventure Activities. ASSUMPTION OF RISKS I am aware that participating in Adventure Activities involves many inherent risks, dangers and hazards including but not limited to: exposed and falling rock, earth, ice, trees or other natural objects; travel on back-country roads; negligence of other participants and other persons; hiking on rough and uneven terrain; changing weather conditions which may cause the trails and apparatus and zip lines to be slippery; equipment failure; failure to properly adjust or fasten equipment; improper use of equipment; falls; over-exertion; failure to remain within designated areas; impact or collision with trees, other participants or guides; and NEGLIGENCE ON THE PART OF THE RELEASEES, INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF PARTICIPATING IN ADVENTURE ACTIVITIES REFERRED TO ABOVE. I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE OR LOSS RESULTING THEREFROM.
