A&D Facility definition

A&D Facility means that portion of the Loan in the amount of Fourteen Million Five Hundred Thousand Dollars ($14,500,000.00) to be used for A&D Improvements to be constructed for the Lots Under Development, as set forth in the A&D Budget.
A&D Facility means the anaerobic diges tion facility and associated infrastructure to be built at the Site (▇▇▇▇▇▇ Road) which forms part of the Works; Additional Permitted Borrowing
A&D Facility means with respect to the Company and its Restricted Subsidiaries, one or more debt facilities with banks or other institutional lenders providing for borrowings, the proceeds of which are required to be used for the acquisition and/or development of real property owned by the Company or such Restricted Subsidiary, in each case, as amended, restated, modified, renewed, refunded, replaced or refinanced, in whole or in part, from time to time.

  • As of the Closing Date, Borrower shall pay to Lender the A&D Facility Fee, and on the Closing Date and the twelve-month anniversary of such date thereafter, Borrower shall pay to Lender the Commitment Fee.
