If, upon annual recertificaton of the income of a Tenant of an Inclusionary Unit, the Owner determines that the Tenant's Annual Household Income exceeds the qualifying income for a Low Income Household, but the Annual Household Income is not over one hundred twenty percent (120%) of Median Income, adjusted for Actual Household Size, then the Tenant may remain in the Inclusionary Unit at the same restricted rent, and the Unit shall continue to qualify as a Low Income Unit.
