Active Business definition

Active Business means the business conducted by each of the ATOB Entities as of the applicable distribution date.

Active Business means any business relied on to satisfy (i) the active trade or business requirement of Section 355(b) of the Code (taking into account Section 355(b)(3) of the Code) or (ii) the continuity of business enterprise requirements under Treasury Regulations Section 1.355-3 and Treasury Regulations Section 1.368-1(d), to the extent identified as such in the Tax Materials.

Active Business means the business conducted by each of the Active Business Entities (as defined herein) as of the Distribution Date.

More Definitions of Active Business

Active Business means an active trade or business relied upon to satisfy the requirements of Section 355 of the Code as set forth in the Ruling Request, as defined below, and in the opinion being delivered by counsel in connection with the Distribution.
