Acticoat 7 Product definition

Acticoat 7 Product means the Acticoat 7 product (referred to in FDA 510 K number K001519) which has the features set out in the Specifications applicable thereto and which was marketed and sold by Nucryst under the tradename “Acticoat 7” immediately prior to the Original Effective Date, together with all Improvements thereto which S&N and Nucryst agree in writing to implement;

  • In the event of a breach by S&N of the foregoing covenant not to compete, the sole remedy of Nucryst shall be to elect hereunder to withdraw the exclusivity of the license and such license shall become non-exclusive in respect of all Products (except Acticoat Product and Acticoat 7 Product with respect to Canada and the United States) on the 90th day after notice in writing hereunder has been received by S&N, and the provisions of this Agreement shall be deemed to be amended accordingly.

Unless a product is considered a milk product under this subdivision, milk product does not include dietary products, infant formula, ice cream or other desserts, cheese, or butter. Milk products include the following:

  • Aerosol coating product means a pressurized coating product containing pigments or resins that dispenses product ingredients by means of a propellant, and is packaged in a disposable can for hand-held application, or for use in specialized equipment for ground traffic/marking applications.

  • Spray buff product means a product designed to restore a worn floor finish in conjunction with a floor buffing machine and special pad.
