AC Unit definition

AC Unit means, collectively, the air-cooled air conditioning units to be purchased and installed by Tenant as part of the Initial Alterations and in accordance with the provisions of this Lease (the “AC Work”), which shall be located in the Premises (or, subject to the provisions of Article 41 of this Lease, on the eighth floor roof), and which shall exclusively service the Premises. The AC Unit shall consist of one or more units providing at least 220 tons, in the aggregate, of cooling for the Premises. The manufacturer and specifications of the AC Unit shall be subject to Landlord’s reasonable approval which approval shall not be unreasonably withheld, delayed or conditioned.

AC Unit means one or more air-cooled air conditioning units to be purchased and installed by Tenant as part of the Alterations to prepare the Additional Premises for Tenant’s initial occupancy. Such AC Unit shall consist of one or more units providing at least 95 tons of cooling for the Additional Premises. The manufacturer and specifications of such AC Unit shall be subject to Landlord’s approval, which approval shall not be unreasonably withheld, delayed or conditioned. Notwithstanding the provisions of Article 41 of the Lease, such AC Unit may not be installed in the Installation Area but shall be installed in the mechanical equipment room in the Additional Premises.

  • If Tenant shall elect not to do so, any improper functioning of the A/C Unit resulting therefrom shall be the sole responsibility of Tenant to cure (at Tenant's sole cost and expense).

  • Neither this Agreement, nor any right or obligation hereunder may be assigned or transferred in whole or in part by Engineer without prior written consent of the City.
