2008 Securities definition

2008 Securities means the Zero Coupon Convertible Subordinated Notes due June 15, 2033, First Putable June 15, 2008, or any of them (each, a “2008 Security”), as amended or supplemented from time to time, that are issued under this Indenture.
2008 Securities means, collectively, the Series A Securities and the Series B Securities. ARTICLE TWO Terms and Issuance of the 2008 Securities SECTION 201. Issue of Securities. A Series of Securities which shall be designated the "6.496% Series A Senior Notes due 2008" and a series of Securities shall be designated the "6.496% Series B Senior Notes due 2008" each shall be executed, authenticated and delivered in accordance with the provisions of, and shall in all respects be subject to, the terms, conditions and covenants of the Original Indenture and this Second Supplemental Indenture (including the forms of 2008 Securities set forth in Exhibits A and B hereto). The aggregate principal amount of the 2008 Securities which may be authenticated and delivered under the Second Supplemental Indenture shall not, except as permitted by the provisions of the Original Indenture, exceed $300,000,000.

  • Rule 144A Securities means all Initial Securities offered and sold to QIBs in reliance on Rule 144A.
