Examples of 1999 Credit Agreement in a sentence
The Borrower, the Administrative Agent, Manufacturers and Traders Trust Company ("M&T") and Citizens Bank of Rhode Island ("CBRI") entered into a Credit Agreement dated as of August 23, 1999 (the "1999 Credit Agreement"), pursuant to which the Lenders agreed to make certain revolving credit and letters of credit facilities available to the Borrower.
All outstanding standby letters of credit issued pursuant to the 1999 Credit Agreement and the letter of credit contemplated by section 3.9 shall automatically be deemed to be Letters of Credit issued pursuant to this section 1.4(a).
U.S. Bank shall have issued a Letter of Credit for the benefit of the issuer of outstanding commercial letters of credit under the 1999 Credit Agreement in an amount equal to the aggregate sum of the largest drafts which could, on the Closing Date or thereafter, be drawn under such letters of credit.
The security interests granted by the Borrower to the Lender under this Agreement are in addition to, and shall be consolidated with, the liens and security interests granted by the Borrower to the Lender under the 1999 Credit Agreement and any other prior security agreement, mortgage or other document, without affecting the lien, priority or effectiveness of those prior liens, security interests and agreements.
This Credit Agreement shall be effective from the Effective Date forward, and the execution of this Credit Agreement shall not relieve any party to the 1999 Credit Agreement from their respective obligations thereunder for the period from the Original Effective Date to the Effective Date or from any liability for the failure to perform such obligations or from any liability arising out of indemnification obligations under the 1999 Credit Agreement.
