This requirement applies to all generators with the exception of a generator that can rely on:(1) one of the statutory exemptions specified in the Electricity (General) Regulations 1997 (Regulations) outlined below;(2) an individual exemption issued by the Commission (with the approval of the Minister) pursuant to section 80(1) of the Act; or(3) an exemption made by Governor under a regulation pursuant to section 98(2)(e) of the Act.

The 1997 Regulations were updated in 1998 by The European Communities (Natural Habitats) (Amendment) Regulations 1998 (S.I. No. 233/1998) to include Council Directive 97/62/EC which served to update Council Directive 92/43/EEC, adapting it to technical and scientific progress made in the intervening years.
This protection means that the member should be in no worse a position than they would have been had Regulation 28 of the 1997 Regulations applied and the conditions of that regulation were met.
With effect from 1 April 2008, this responsibility to review and, where necessary, revise “Governance Compliance Statements” published under Regulation 73A of the 1997 Regulations, is set out in Regulation 31 of the 2008 Regulations, with reasons for non compliance required under Regulation 31(3) (c).
For all practical purposes, Regulation 27 of the 1997 Regulations remained in force in the transitional period.
Under regulation 20 (15), transitional protections applied for determinations made before 1 October 2008 to provide that if the benefits payable to a member under the amended regulation 20 would have placed him in a worse position than he would have otherwise been had the 1997 Regulations continued to apply, then those Regulations shall apply as if they were still in force.
The employer also needed to consider whether the member was entitled to ill health benefits under the 1997 Regulations.
Where compliance does not meet the published standard, there is a requirement, under Regulation 73A(1)(c) of the 1997 Regulations, to provide the reasons for not complying.
