Common use of Liability Clause in Contracts

Liability. 14.1. Drei cannot be held liable for damages arising from force majeure (e.g. fire and water damage, lightning strike), the effects of terminal equipment used by the customer or any interruptions in operation due to maintenance works or preventing/remedying faults in the network, as well as the actions of third parties not attributable to Drei. Liability for intent and gross negligence on the part of Drei remains unaffected. 14.2. For any liability of Drei or of Drei's suppliers to the customer with regard to the content, accuracy or completeness of data, messages, addresses, routing or other information provided within the framework of Drei's services, Drei shall be liable for intent and gross negligence within the constraints of the statutory provisions. The customer cannot derive any legal claims against Drei or suppliers of Drei from the use of this information.
