This Management Agency Agreement (hereinafter “Agreement") is entered into by and between the Central Valley Regional Water Quality Control Board (hereinafter ”Regional Water Board”), acting through the Executive Officer, and the United States Bureau of Reclamation1 (hereinafter “Reclamation”), acting through the Regional Director of the Mid Pacific Region, for the purpose of addressing certain salt imports to the Lower San Joaquin River (LSJR). The Agreement is a cooperative means of implementing relevant provisions of the Regional Water Board’s Water Quality Control Plan for the Sacramento River and the San Joaquin River Basins – 4th Edition (Basin Plan).

Between January 25, 2018 and September 6, 2022, the Discharger reported 13 sanitary sewer overflows8 of untreated wastewater that entered surface waters. The Discharger has attributed these sanitary sewer overflows to operational and structural failures, including root intrusion, grease deposition, the presence of debris, and a lack of hydraulic capacity in the sewer. The 13 spills are listed in Table 2, below. Each incident is of similar magnitude and is therefore considered together instead of individually.

Since public review of the Aquatic Habitat Conservation Plan/Candidate Conservation Agreement with Assurances (AHCP/CCAA) dated July 2002, Green Diamond Resources Company (Green Diamond) has worked with staff of the National Marine Fisheries Service (NMFS) and U.S. Fish and Wildlife Service (USFWS) to respond to comments on and revise sections of the AHCP/CCAA.
