WHEREAS, the discharge of dredged or fill material into waters of the United States and waters of the Commonwealth of Kentucky, including wetlands and/or streams, is regulated pursuant to Section 404 of the Clean Water Act, 33 U.S.C. § 1344, and/or Section 401 of the Clean Water Act, 33
