This Environmental Covenant (this “Covenant”) is entered into pursuant to Ohio Revised Code (“R.C.”) Sections 5301.80 to 5301.92 by the State of Ohio for the benefit of the Ohio Turnpike and Infrastructure Commission (the “Owner”), having an address of 682 Prospect Street, Berea, Ohio 44017 and the Ohio Environmental Protection Agency (“Ohio EPA”), as a non-holder agency, for the purpose of subjecting the Covenant Area (as defined herein) to the activity and use limitations set forth herein.

This environmental covenant is established pursuant to 2005 Iowa Acts, Senate File 375 (to be codified as Iowa Code chapter 455L and hereafter cited as Iowa Code chapter 455L.) [name(s) of fee title owners of affected property], hereafter "grantor(s)" and [names of all holder(s)] enter into this environmental covenant for the purpose of subjecting the property described below to certain activity and use limitations in accordance with the terms and conditions as specified below and the provisions in Iowa Code chapter 455L , Iowa Code section 455H.206 and Iowa Department of Natural Resources (Department’s) rules in chapter 567 Iowa Administrative Code (IAC) 137.
