Contractor shall conduct all operations hereunder in contractor’s name and not in the name of the shipper. Exception shall be made when contractor tenders shipments to ocean carriers at shipper’s request. In this event, contractor shall tender goods to the ocean carrier under shipper’s name. Contractor is not an NVOCC, and merely acts as shipper’s agent with respect to tendering goods to ocean carriers.
