This CAPACITY USAGE AGREEMENT (together with the Exhibit attached hereto and made a part hereof, the “Agreement”) is made and entered into this [__] day of [_______], [___] (“Effective Date”), by and between NEXUS Capacity Services, ULC, a British Columbia unlimited liability company (“NEXUS”), and [_______](“Customer”). NEXUS and Customer are sometimes referred to herein individually as a “Party” or collectively as the “Parties.”
