In May 2013 the Village entered into a Tower Lease Agreement (the “Agreement”) with Infinite Inet, Inc. d/b/a Air-Wans (“Air-Wans”) to provide Air-Wans a non-exclusive easement for access to certain of the Village’s water towers for placement of omni antennas and other related equipment. Subsequently Air-Wans was acquired by Apps Communications, Inc. (“Apps”). The Agreement has expired and the Village and Apps desire to renew the Agreement with slight modifications. Those modifications include, but are not limited to, extending the term of the Agreement to five years, providing default provisions and default remedies, and including holdover terms. Staff believes the proposed Agreement comprehensively regulates the non-exclusive easement for use of the licensed premises.
