[Customer], for itself and on behalf of its Brazilian subsidiaries and affiliates (“Customer”), Dura Automotive Systems, LLC, for itself and on behalf of its subsidiaries and affiliates which have commenced proceedings under chapter 11 of title 11 of the United States Code (collectively, the “Supplier”), which are currently pending in the United States Bankruptcy Court pending in the District of Delaware, Case No. 19-12378 (the “Bankruptcy Proceedings”) before the Honorable Karen B. Owens (the “Bankruptcy Court”), (Customer and Supplier are collectively called the “Parties”) enter into this Accommodation Agreement (“Agreement”) as of April , 2020, but effective only upon the Effective Date (defined below).
