THIS SETTLEMENT AGREEMENT AND RELEASE (the “Agreement”) is entered into by and between plaintiff Christy Luckey, individually and in her representative capacity as a plaintiff on behalf of the class of persons defined below (“Plaintiff”), and defendant Swim or Sink, Inc. d/b/a Canyon Beachwear (“Canyon Beachwear” or “Defendant”). Plaintiff and Defendant are collectively referred to herein as the “Parties.”
