These Terms and Conditions, along with the SUDS Subscription Services Agreement and the DRB Terms and Conditions, shall hereinafter collectively be referred to as the (“Agreement”). This Agreement is entered into by and between DRB Systems, LLC, doing business as SUDS Creative (“SUDS”) and the Licensee named in the SUDS or DRB Order Form or other ordering document (“Order Form”) and including all entities controlled by or under common control therewith (the “Licensee”). These Terms and Conditions shall govern and control unless, and to the extent, the Order Form conflicts. In that instance, the Order Form shall prevail. For existing Licensees of the SendIt, ChurnBurner, ScanIt, ShoutIt, and StatsDashboard Services, these Terms and Conditions supersede any prior Terms and Conditions. SUDS and Licensee may be referred to herein individually as a (“Party”) or collectively as (the “Parties”). Accordingly, the Parties expressly acknowledge and agree to the following Terms and Conditions:
