Xxxxx Costs. The parties shall each bear their own legal costs in relation to the preparation, negotiation and enforcement of this Agreement.

Xxxxx Costs. Xxxxx Costs" are hereby defined as the purchase ----------- price of thirteen million five hundred thousand ($13,500,000) dollars paid by Xxxxx for the Lehigh Property plus or minus the closing adjustments (such as tax prorations, transfer taxes, utility prorations and like adjustments) paid or received by Xxxxx in connection with such acquisition, plus the other costs incurred by Xxxxx on or after December 9, 1994 in connection with such acquisition and development of the LLC Property, all as listed on attached Exhibit F.
Xxxxx Costs. If any litigation is commenced between the parties to this Agreement that arises out of, relates to, or is connected with the enforcement, interpretation, or the rights and duties of any party under this Agreement, the prevailing party shall be entitled to, in addition to any other relief that may be granted in the litigation, reasonable attorneys' fees and costs, including expert and consultant fees, as determined by the court presiding over the dispute.
Xxxxx Costs. The Developer shall pay on the date of this Deed to the Council its reasonable legal costs properly incurred in the negotiation and completion of this Deed up to the sum of £[ ] (to the extent not already paid).
Xxxxx Costs. The Lessee shall be responsible for all costs on an attorney and own client scale arising from the Lessor exercising its rights in terms of this agreement; and the Lessor will be entitled to apply interest on any outstanding amounts at the rate of prime plus 2% per annum.

Xxxxx Costs. The Licensee shall reimburse any costs incurred by the County or its agents, contractors, or licensees or franchisees as a result of any delays to County projects caused by the Licensee’s failure to fulfill, in accordance with any applicable County activity schedule, any obligation imposed upon the Licensee by law or by this Agreement, including but not limited to those imposed pursuant to Subparagraphs (A) or (B). In the event the County incurs such costs, directly or indirectly, the County shall submit a xxxx to the Licensee for the incurred costs, and the Licensee shall pay the County the invoiced amount within sixty calendar days of receipt of the invoice. If the invoice is not paid by the Licensee in a timely manner, all rights granted to the Licensee under this Agreement shall be suspended, no permits will be issued to the Licensee for any work within the public right of way, and the Licensee will continue to be liable for such costs until they are paid in full.
Xxxxx Costs. In the event that the Executive institutes any legal action to enforce his rights, or to recover damages for breach of the Company’s obligations, under this Agreement and this Section 6, the Executive in such an action shall be entitled to recover from the Company all costs and expenses (including, without limitation, attorneys’ fees and disbursements) incurred by him if he prevails in any such action or if any such action is settled in his favor.
