WORKERS’ COMPENSATION AND UNEMPLOYMENT COMPENSATION. All nurses shall be provided coverage under the State of Washington Worker’s Compensation Law and the Unemployment Compensation law.

DPSG shall have and assume the obligations for all claims and liabilities relating to workers compensation and unemployment compensation benefits for all DPSG Business Employees and Former DPSG Employees. Cadbury shall have and assume the obligations for all claims and liabilities relating to workers compensation and unemployment compensation benefits for all Cadbury Business Employees and Former Cadbury Employees. DPSG and Cadbury shall make reasonable commercial efforts to provide that workers compensation and unemployment insurance costs are not adversely affected for either of them by reason of the Distribution.

WORKERS’ COMPENSATION AND UNEMPLOYMENT COMPENSATION. During the Term and subject to Mediaco’s reimbursement obligation under Section 3, Emmis shall be responsible for (i) maintaining valid workers’ compensation insurance for the Leased Employees, and (ii) all unemployment compensation claims filed by any Leased Employee; provided, however, any and all out-of-pocket expense associated with the foregoing shall be paid by Mediaco to Emmis consistent with Section 3 above.
WORKERS’ COMPENSATION AND UNEMPLOYMENT COMPENSATION. Effective as of July 1, 2010, B&W shall have (and, to the extent it has not previously had such obligations, assume) the obligations for all claims and liabilities relating to workers’ compensation and unemployment compensation benefits for all B&W Employees and Former B&W Employees. Effective as of July 1, 2010, MII shall have (and, to the extent it has not previously had such obligations, assume) the obligations for all claims and liabilities relating to workers’ compensation and unemployment compensation benefits for all McDermott Employees and Former McDermott Employees. B&W and MII shall use commercially reasonable efforts to provide that workers’ compensation and unemployment insurance costs are not adversely affected for either of them by reason of the Distribution.
WORKERS’ COMPENSATION AND UNEMPLOYMENT COMPENSATION. Effective as of the Closing Date, Constar shall assume all Liabilities for Active Constar Employees and Former Constar Employees related to any and all workers’ compensation and unemployment compensation matters under any law of any state, territory, or possession of the United States or the District of Columbia and Constar shall be fully responsible for the administration of all such claims. If Constar is unable to assume any of such Liabilities or the administration of any such claim because of the operation of applicable state law or for any other reason, Constar shall reimburse Crown for all such Liabilities.
WORKERS’ COMPENSATION AND UNEMPLOYMENT COMPENSATION. The Employer will provide Workers’ Compensation insurance and Unemployment Compensation insurance in accord with the laws of the State of Washington, including through a self-insured plan.

Nuvectra shall use commercially reasonable efforts to provide that workers’ compensation and unemployment insurance costs are not adversely affected for either Party by reason of the Distribution.
