Where the Occupant Clause Samples
The 'Where the Occupant' clause defines specific rights, obligations, or conditions that apply to the individual or entity occupying a property under a lease or similar agreement. Typically, this clause outlines scenarios in which the occupant must take certain actions, such as maintaining the premises, notifying the landlord of issues, or complying with building regulations. For example, it may specify what happens if the occupant wishes to sublet the property or make alterations. The core function of this clause is to clarify the occupant's responsibilities and the circumstances under which they must act, thereby reducing ambiguity and potential disputes between the parties.
Where the Occupant. 11.3.1 owes arrears at the termination of this Agreement; or
11.3.2 is in arrears for more than seven (7) days or the arrears exceed the Room Deposit, the University may place a negative service indicator on the Occupant's academic record that will prevent the release of results, academic transcripts and/or the Occupant's eligibility to graduate.
Where the Occupant. 5.6.1 owes arrears at the termination of this Agreement; or
5.6.2 is in arrears for more than seven (7) days during the Occupancy and the Occupant fails to respond to a notice from an authorised representative of the University regarding the unpaid amount(s), the University shall be entitled to place a negative service indicator on the Occupant's academic record that will prevent the release of results, academic transcripts and/or the Occupant's eligibility to graduate.
Where the Occupant has signed the Occupation Agreement for the next academic year and the provisions of para 1 are not applicable, provided such cancellation takes place before 31 December, a cancellation penalty of R5000.00 shall apply.
